Subscriber Agreement

IN NO EVENT WILL AXCIS INFORMATION NETWORK, INC. (“AXCIS”) BE HELD LIABLE FOR DAMAGES IN CONTRACT, TORT, OR OTHERWISE, FOR ANY INACCURATE OR ERRONEOUS DATA, MISTAKES IN PROCESSING, OR ANY OTHER CAUSES OF ERROR RELATING TO THIS PRODUCT AND/OR THE DATA AND/OR INFORMATION CONTAINED HEREIN AND IN NO EVENT SHALL AXCIS HAVE ANY RESPONSIBILITY OR LIABILITY FOR CONSEQUENTIAL, SPECIAL, PUNITIVE OR INCIDENTAL DAMAGES ARISING IN CONNECTION WITH OR RELATED TO THE USE OF THIS PRODUCT OR THE DATA OR INFORMATION.

Users may not resell such products either directly or indirectly. Non-compliance with these provisions may result in termination of user’s ability to access the DRF Electronic Products.

The data used to create the DHP and HarnessEye products includes data provided by AXCIS Information Networks, Inc. Unauthorized copying of such data, including modifications thereof, or the creation of programs or products in which such data have been merged or included with other data programs or products, for distribution to third parties, whether gratuitously or for sale, is expressly forbidden. You may be held legally responsible for any proprietary or copyright infringement that is caused or encouraged by your failure to comply with these Terms and Conditions of Use.

You may not transfer the DHP and/or HarnessEye products from one computer to another. You may not distribute copies of the DHP and/or HarnessEye products to third parties. You may not create derivative works based upon the DHP and/or HarnessEye products.

The DHP and/or HarnessEye products are for your use only and may not be transferred to anyone else. In no event, may you transfer, assign, rent, lease, sell, or otherwise dispose of the DHP and/or HarnessEye products on a permanent or temporary basis except as expressly provided for herein.

If you breach any of these Terms and Conditions of Use, The Daily Racing Form, LLC, Axcis Information Network, Inc. and/or the United States Trotting Association, in addition to pursuing any other legal remedies available to them, may immediately terminate your right to access the DHP and/or HarnessEye products.

Your purchase of the DHP and/or HarnessEye products indicated your acceptance of these Terms and Conditions of Use.
